I'm guessing it has a salvage title or something.

That being said, a lot of M6s have dropped below the $40,000 mark recently. I think there's just not a lot of demand for them and there's a lot being sold. Might be worth picking one up.

If you've got the money to maintain it (the hydraulics on that SMG will fail), buy it, if only for the glorious V10 noise.

Out of warranty, so will be achingly, stabbingly, burningly expensive to fix when things go wrong is all I can figure.

Plus the joy sucking vortex of the DSG from that era.

If it's not salvage title it's because they are expensive to maintain.

That's a good deal, but not too crazy for an M6 with thy many miles. German cars lose value like crazy, especially ones with V10s. There is an M5 near me on Car Max for $29k right now, and they're usually a little more expensive than dealers.
